Case studies from our investigation practice
Below are three anonymised, real cases from our investigation practice: one for employers (sick leave), one for business owners (a non-compete clause) and one for individuals (adultery). Names, locations and other identifying details have been removed or altered to protect the privacy of everyone involved.
Sick leave: presence and activity during a long-term sick-listing
Situation: An employer had a labour dispute with a long-term sick-listed employee and received signals that the employee was regularly present at an external work location and possibly carrying out work there, potentially for another organisation.
Approach: A multi-day static and dynamic surveillance investigation, with supporting footage.
Result: The findings were recorded objectively and chronologically in a report and used during the hearing process and the further assessment of the labour dispute.
Non-compete clause: breach by a former business partner
Situation: A business owner suspected that a former business partner, in breach of an agreed non-compete clause, was working for a business relation of the company.
Approach: Observations on separate, non-consecutive occasions at the business location of the relation.
Result: The former partner's presence was objectively documented, supporting the legal assessment of the non-compete clause.
Adultery: suspected extramarital relationship
Situation: A private client wanted clarity about a suspected extramarital relationship involving a family member.
Approach: Discreet evening surveillance on two occasions.
Result: The nature and intensity of the contact between the person under investigation and the third party involved were objectively documented.
